John W. Shaw
John leads trial teams before United States district courts around the nation, the United States International Trade Commission, and the Delaware state courts. Past successes notably include a Section 337 action before the United States International Trade Commission, in which John’s client won on all five patents asserted by the petitioner.
John’s past and present matters include patent infringement actions involving herbicides, RNA/DNA analytical technologies, liquid chromatography technologies, LED lenses, e-commerce web-sites, multi-function printers, Blu-ray players, personal location beacons, and backup and restore technologies; a trade secret misappropriation action involving chemical intermediates used in life sciences research; patent licensing disputes; patent indemnity matters in the semiconductor industry; specific performance actions to secure continued manufacture of a life-critical veterinary drug and to secure payment of a nine-figure contractual indemnity; and defense of an eight-figure fraud and breach of contract action.
John began his career in the prestigious Edison Engineering Program at General Electric, where he worked on the mechanical design of jet engine control computers. After clerking for Senior Judge Murray M. Schwartz, John practiced at one of Delaware’s largest law firms for 16 years, including 10 as a partner, before founding Shaw Keller LLP.
John has represented a wide variety of pro bono clients over the course of his career, including trying four civil rights actions to a jury in the Delaware District Court. John and his team secured a plaintiff’s verdict (including compensatory and punitive damages) in two of these trials, and successfully resolved pro bono appeals for clients before the U.S. Court of Appeals for Veteran Claims. For these and other pro bono activities, John has received the Caleb R. Layton III Service Award from the Delaware District Court.
